Right to terminate membership We reserves the right to terminate membership of anyone due to whatever reasons. WishMeSuccess is not responsible or liable for any damages including loss of data as a result of termination of membership. 7. Right to terminate the Site We reserve the right to terminate the Site or any services of the Site at anytime for any reasons, with or without notice. WishMeSuccess will not be responsible and liable for any damages or losses, including but not limited to direct, indirect, consequential, incidental or punitive damages and losses that arises as a result of the termination of the Site. We highly encourage members to backup their materials on the Site. 8. Use Of Contact Information. We reserve the right to contact any individual who has supplied their e-mail address with system generated messages, promotional offers, and any other communication while the user remains registered in our database. Under our privacy agreement, individuals will have the right to unsubscribe which will remove them from our system. Registered Members may render their membership un-usable if unsubscribing. Leads supplied by other individuals through the "Tell your Friends" functionality will be removed from our database upon unsubscription. 9. Your obligations. Miscellaneous. This Agreement shall all be governed and construed in accordance with the laws of Australia applicable to agreements made and to be performed in Australia. You agree that any legal action or proceeding between WishMeSuccess and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Australia. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. WishMeSuccess's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right.
